Matter on the Law & Motion/Discovery Calendar for Monday, September 15, 2025, line 1 STATUS HEARING

On June 13, 2025, the court heard petitioner Jayson Alpon's petition to compel arbitration. The court's tentative stated as follows: "Petitioner Jayson Alpon moves to compel arbitration against Blue Hill Specialty Insurance Company. Alpon, who was driving for Uber, was in a collision with a driver who did not stop. Petitioner made a claim against Blue Hill and the matter was set to go to arbitration pursuant to Insurance Code 11580.2(f). Blue Hill asked for a continuance because a passenger in Alpon's rideshare vehicle, Brian Limon Santiago, submitted a claim; Blue Hill now contends that Santiago is a necessary party and asks the court to order Santiago to arbitration as well. "Santiago is not a party to this action and has not been served with process that would provide the court with jurisdiction to issue orders to him.

The court orders the parties to arbitrate this dispute and to select an arbitrator within 90 days to schedule the arbitration. This gives Blue Hill time to secure Santiago's presence including through a petition to compel arbitration if needed. "The court sets the matter for a status hearing on September 15, 2025 at 9 a.m. in Department 301. If the parties have not agreed on an arbitrator and commenced the arbitration by that date, each party is to submit three suggested arbitrators by supplemental briefing due five court days in advance of the continued hearing date."

No party has submitted supplemental briefing indicating that they require the court's assistance to select an arbitrator. The court therefore orders the matter off calendar.

For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept301tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.

The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
