ORDER TO SHOW CAUSE RE: PRLIMINARY INJUNCTION AGAINST DEFENDANTS TODD BRABEC AND NANCY GOLDSEN per november 05, 2025 order filed. is continued to January 7, 2026.
426 Fillmore Association, a party to this action, responsible for maintenance of common areas. As alleged in the operative complaint "All roofs at 426 Fillmore Street are common area." (paragraph 41). This motion, inter alia, requests the permission for "further inspection, repair, maintenance and or/replacement of the aforementioned roof and ceiling."
Therefore, the HOA is ordered to, with Plaintiff's and other defendants' full cooperation, to inspect the roof and the ceiling on a mutually agreeable date on or before December 11, 2025. If parties cannot agree on a date, the inspection shall proceed on December 11, 2025 at 3:30 p.m.
Upon the completion of the inspection, HOA shall provide a plan for remediation, if any is necessary (including, but not limited to: timeline for completion; necessary steps to complete the repairs; process for hiring a contractor; party responsible for completing the repairs, etc.) no later than January 5, 2026. Other parties may provide their own plans for remediation no later than January 5, 2026.
Supplemental briefs submitted by the parties shall also include any relevant information re: December 17, 2025 deposition of Kevin Kearney. Supplemental briefs shall not exceed 3 pages and shall be accompanied by supporting declarations. =(501/AAT)
