22 A. Procedural History 23 1) Petitioner Scott Dickie (Father) and Respondent Janet Lee (Mother) married on 9/5/2009. Both 24 parties state that their date of separation is “TBD.” The parties have two minor children, William 25 (DOB: 10/23/2012, age 13) and Sophia (DOB: 5/11/2016, age 9). Father is represented in limited 26 scope by attorney Kristen Van Antwerp of Moradi Neufer LLP. Mother is represented by attorney 27 Lisa Tarr of Winter & Ross. 28 2) On 11/21/2025, a Stipulation and Order was filed which provides in relevant part that the parties 29 shall share joint legal and physical custody and will have visitation of the children according to a
1 week on / week off schedule. In addition, the parties agreed that Father would move out of the 2 family residence and Mother would have temporary exclusive use of the family residence 3 pending further Court order or agreement, with Mother responsible for making the payments for 4 the mortgage, property taxes, utilities, and related routine maintenance costs. 5 3) On for hearing is Father’s Amended Request for Order filed 1/5/2026 (seeking additional child 6 custody orders) as well as Father’s Request for Order filed 12/15/2025 seeking guideline child 7 support and temporary guideline spousal support as well as Smith / Ostler child and temporary 8 spousal support retroactive to 11/22/2025 (the date Father vacated the family residence); an order 9 for sharing of mandatory and agreed-upon child support add-ons (including private school 10 tuition); as well as an order requiring that the parties’ vacation property in Truckee, CA be listed 11 for sale no later than 5/1/2026. 12 4) On 12/15/2025, Father filed a Memorandum of Points and Authorities in Support of his Request 13 for the Sale of Vacation Property. 14 5) On 12/15/2025, Father filed an Income and Expense Declaration. 15 6) On 12/15/2025, Father filed a Statement of Support Calculations. 16 7) On 3/24/2026, Father filed an Income and Expense Declaration. 17 8) On 4/3/2026, Mother filed a Responsive Declaration responding to Father’s custody and 18 visitation requests. 19 9) On 4/3/2026, Mother filed a second Responsive Declaration responding to Father’s 12/15/2025 20 Request for Order.

Mother agrees to pay guideline child and temporary spousal support orders. 21 However, Mother also states that she was terminated from her employment effective 3/13/2026 22 and is currently receiving disability benefits of $1,765 per week. Mother states that she expects to 23 receive a severance payment of $190,000. 24 10) On 4/3/2026, Mother filed an Income and Expense Declaration. 25 11) On 4/3/2026, Mother filed a Declaration by James Good, CPA, CFF with a Statement of Support 26 Calculations. 27 12) On 4/9/2026, Father filed a Reply Declaration in Support of his Amended Request for Order on 28 Child Custody and Visitation as well as a Reply Declaration in Support of his Request for Orders 29 for Child Support, Spousal Support, and Sale of Truckee, CA.
1 13) On 4/9/2026, Father filed an Updated Statement of Support Calculations. 2 14) On 4/13/2026, the parties filed a Stipulated Protective Order Regarding Confidential Information. 3 B. Findings and Order 4 1) This Court has jurisdiction to make child custody orders in this case under the Uniform Child 5 Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party in 6 violation to civil or criminal penalties, or both. The country of habitual residence of the minor 7 child is the United States. 8 2) The parties are ordered to appear to discuss the parties’ requests related to the holiday 9 schedule and other requests related to custody,. 10 3) On the Court’s own motion, the hearing on Father’s Request for Order filed 12/15/2025 11 requesting child and temporary spousal support orders and an order regarding the parties’ 12 vacation home is hereby continued to Tuesday, 5/19/2026 at 9:00 AM in Dept. 404.
The parties 13 shall continue to meet and confer regarding the issues set forth in Father’s 12/15/2025 Request 14 for Order. 15 4) Father’s attorney shall prepare the Findings and Order After Hearing. 16 5) Preparation of Order: If you are directed by the court to prepare the order after hearing – within 17 10 calendar days of the hearing you must either: (a) Serve the proposed order to the other 18 party/counsel for approval, and follow the procedures set forth in CA Rules of Court, Rule 19 5.125(c), or (b) If the other party did not appear or the matter was uncontested, submit the 20 proposed order after hearing directly to the court.
Failure to submit the order after hearing within 21 10 days may allow the other party to prepare a proposed order and submit it to the court in 22 accordance with CA Rules of Court, Rule 5.125(d). 23
