Plaintiff Zahraya T. Woods' Motion for Claim and Delivery is DENIED. The court does not find Plaintiff has established probable validity of her claim to an exclusive right of possession. The record would support a finding the vehicle was purchased with Plaintiff's funds and Plaintiff was personally involved in the purchase. The parties, however, shared possession of the vehicle, at least up to the second half of December. The vehicle is registered in Defendant's name. On December 29, 2025, the police facilitated a transfer of possession to Defendant. The parties' respective rights of possession are not sufficiently clear to support issuance of a writ providing for Plaintiff's exclusive possession of the vehicle at this time. (Code of Civil Procedure section 512.060(a)(1).)

Second, the record contains no information about the location of the vehicle. If the vehicle is likely in a private place, there is no showing of probable cause to believe the vehicle is located there. (Code of Civil Procedure section 512.060(6).)

Third, even if the record supported issuance of a writ, Petitioner would be required to post an undertaking of $5,000. (Code of Civil Procedure section 512.060(a)(2).)

Fourth, the court is without a proposed order or a proposed writ of possession.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.

The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
