Assignee of record and judgment creditor Collect Access, LLC (Creditor) unopposed Application for Order for Sale of Dwelling located at 5636 Da Vinci Way in Sacramento is ruled upon as follows.
This matter was previously continued to permit Judgment Debtor Bikram Jam Singh (Judgment Debtor) to file a written opposition to the application. The Courts minute order states that Judgment Debtor was to file his opposition in compliance with Code of Civil Procedure section 1005(b). Judgment Debtor has filed no such opposition.
According to the moving papers, Creditor obtained a judgment against Judgment Debtor Bikram Jam Singh (Judgment Debtor) in 2008 and it was subsequently renewed in 2017, with a current outstanding balance of $13,942.06. (Zee Decl., ¶¶ 4, 5.) An abstract of judgment was recorded in Sacramento County in April 2019. (Zee Decl., ¶ 7.) Defendant/Judgment Debtor Bikram Jam Singh appears to have acquired the property on or about October 31, 2019. (Zee Decl., ¶ 8.) The title of the property is currently held by Judgment Debtor and Arwandeep Kaur. (Zee Decl., ¶ 9.) On September 15, 2025, the Sheriff levied upon the subject property and caused a Notice of Levy to be recorded with the County of Sacramento Recorder's Office and served on Debtor. (See Zee Decl., ¶ 10, Exh. B.)
No Order to Show Cause (OSC) pursuant to Code of Civil Procedure section 704.770 has been issued in this case. Code of Civil Procedure section 704.750 allows for an application for order for sale of a dwelling. The required contents of the application are as follows:
The judgment creditor's application shall be made under oath, shall describe the dwelling, and shall contain all of the following:

(b) A statement, which may be based on information and belief, whether the dwelling is a homestead and the amount of the homestead exemption, if any, and a statement whether or not the records of the county recorder indicate that a homestead declaration under Article 5 (commencing with Section 704.910) that describes the dwelling has been recorded by the judgment debtor or the spouse of the judgment debtor.
(c) A statement of the amount of any liens or encumbrances on the dwelling, the name of each person having a lien or encumbrance on the dwelling, and the address of such person used by the county recorder for the return of the instrument creating such person's lien or encumbrance after recording.
(d) A statement that the judgment is based on a consumer debt, as defined in subdivision (a) of Section 699.730, or that the judgment is not based on a consumer debt, and if the judgment is based on a consumer debt, whether the judgment is based on a consumer debt that was secured by the debtor's principal place of residence at the time it was incurred or a statement indicating which of the exemptions listed in subdivision (b) of Section 699.730 are applicable. If the statement indicates that paragraph (7) of subdivision (b) is applicable, the statement shall also provide the dollar amount of the original judgment on which the lien is based. If there is more than one basis, the statement shall indicate all bases that are applicable.
(Code Civ. Proc. § 704.760.) Based on the declaration of Tappan Zee, the Court finds that Creditor has complied with the requirements of Code of Civil Procedure sections 704.750 and 704.760 in bringing the present application for order of sale of dwelling. (See generally Zee Decl.)
Where the application is sufficient, an OSC shall issue:
(a) Upon the filing of the application by the judgment creditor, the court shall set a time and place for hearing and order the judgment debtor to show cause why an order for sale should not be made in accordance with the application. The time set for hearing shall be not later than 45 days after the application is filed or such later time as the court orders upon a showing of good cause.

(b) Not later than 30 days before the time set for hearing, the judgment creditor shall do both of the following:
(1) Serve on the judgment debtor a copy of the order to show cause, a copy of the application of the judgment creditor, and a copy of the notice of the hearing in the form prescribed by the Judicial Council. Service shall be made personally or by mail.
(2) Personally serve a copy of each document listed in paragraph (1) on an occupant of the dwelling or, if there is no occupant present at the time service is attempted, post a copy of each document in a conspicuous place at the dwelling.
(Code Civ. Proc. § 704.770.) Creditors proposed order submitted with its application erroneously purports to grant the application without an OSC. An OSC is required under Code of Civil Procedure section 704.770. In the alternative, the Court shall hereby issue an OSC as set forth herein.
ORDER TO SHOW CAUSE
It is HEREBY ORDERED that Judgment Debtor appear on May 20, 2026 at 1:30 p.m. in Department 8D located at 500 G St, Sacramento, CA 95814 to show cause, if any, why Creditors' application for order for sale of dwelling should not be granted.
It is further ORDERED that this minute order shall constitute the Order to Show Cause, a copy of which shall be served on Judgment Debtor, along with a Notice of Hearing and Creditors' Application for Order for Sale of Dwelling, personally or by mail pursuant to Code of Civil Procedure section 704.770. Copies of each of these documents shall also be personally served on the occupant(s) of the Property or, if no occupant(s) are present at the time service is attempted, posted in a conspicuous place at the Property. Service and posting of these documents shall be accomplished at least thirty (30) days before the date of the hearing of May 28, 2024.
Opposition, if any, shall be filed and served no later than May 7, 2026. Any reply shall be filed and served no later than May 13, 2026.
The forty-five (45) day rule set forth in Code of Civil Procedure section 704.770, subdivision is waived for good cause given the Court's impacted calendar and the procedural issues discussed above.
Creditor shall prepare a proposed Order and Order to Show Cause consistent with the Courts
