NOTICE:
Consistent with Local Rule 1.06(B), any party requesting oral argument on any matter on this calendar must comply with the following procedure:
To request limited oral argument, on any matter on this calendar, you must call the Law and Motion Oral Argument Request Line at (916) 874-2615 by 4:00 p.m. the Court day before the hearing and advise opposing counsel. Unless ordered to appear in person by the Court, parties may appear remotely either telephonically or by video conference via the Zoom video/audio conference platform with notice to the Court and all other parties in accordance with Code of Civil Procedure §367.75. Although remote participation is not required, the Court will presume all parties are appearing remotely for non-evidentiary civil hearings.

A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.

a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided.
TENTATIVE RULING
Assignee of record and judgment creditor Collect Access, LLC (Creditor) unopposed Application for Order for Sale of Dwelling located at 5636 Da Vinci Way in Sacramento is ruled upon as follows.
According to the moving papers, plaintiff obtained a judgment against Judgment Debtor Bikram Jam Singh (Judgment Debtor) in 2008 and it was subsequently renewed in 2017, with a current outstanding balance of $13,942.06. (Zee Decl., ¶¶ 4, 5.) An abstract of judgment was recorded in Sacramento County in April 2019. (Zee Decl., ¶ 7.) Defendant/Judgment Debtor Bikram Jam Singh appears to have acquired the property on or about October 31, 2019. (Zee Decl., ¶ 8.) The title of the property is currently held by Judgment Debtor and Arwandeep Kaur. (Zee Decl., ¶ 9.) On September 15, 2025, the Sheriff levied upon the subject property and caused a Notice of Levy to be recorded with the County of Sacramento Recorder's Office and served on Debtor. (See Zee Decl., ¶ 10, Exh. B.)
The application does not indicate when (or whether) the Sheriff's Office served Creditor with a Notice of Levy. Code of Civil Procedure section 704.750(a) requires the levying officer to promptly serve the judgment creditor with notice that the levy has been made and that the property will be released unless the judgment creditor complies with the requirements of that section. The statute further provides: Within 20 days after service of the notice, the judgment creditor shall apply to the court for an order for sale of the dwelling and shall file a copy of the application with the levying officer.
If the judgment creditor does not file the copy of the application for an order for sale of the dwelling within the allowed time, the levying officer shall release the dwelling. (Code Civ. Proc. § 704.750(a).) Because the application does not state when the Sheriff's Office served Applicant with a Notice of Levy, it is not clear whether this application was timely filed 20 days after service of the Notice, and thus it is not clear whether the Sheriff has released the levied property. Applicant's memorandum states that the Notice of Levy was mailed to counsel for Judgment Creditor Assignee on September 16, 2025. (App.
MPA, p. 4:19.) However, this information is not stated in counsel's declaration.
Accordingly, the application is DENIED without prejudice.
