19 A. Procedural History 20 1) Petitioner Patricia Weir (Mother) and Respondent Carl Warren Craddock (Father) have one minor 21 child, Elyse (DOB 7/23/2018, age 7). 22 2) On 6/30/2025, Father filed a request seeking joint legal and physical custody and increased 23 parenting time. 24 3) On 7/29/2025, Mother filed a response requesting (1) co-parent counseling with Dr. Lyn 25 Greenberg and (2) for Dr. Greenberg to access both parents’ mental health providers and provide 26 a report to the Court before any modifications to the parenting time are made. 27 4) After hearing on 10/16/2025, the Court, among other things, ordered parenting time for Father 28 from pick-up on Thursday after school (or 2:30PM if no school) until Saturday at 8PM, with a 29 check-in phone or video call for Mother and Elyse on Friday after school or evening. The Court
1 also set a holiday schedule, ordered the parties to work with Dr. Greenberg, denied Mother’s 2 request for Dr. Greenberg to have access to either party’s individual therapist, ordered therapy for 3 Elyse, and ordered the parties to be sober during their custodial times. 4 5) At a 4/6/2026 review hearing, the Court ordered, pending the parties’ selection of a coparent 5 counselor, that Father’s parenting time shall be on a two-week rotating schedule as follows: Week 6 1: Pick-up on Wednesday after school (or 2:30PM if no school) until Friday drop-off at school (or 7 9AM if not school); Week 2: Pick-up on Friday after school (or 2:30PM if no school) until 8 Monday morning drop-off at school (or 9AM if no school).
The Court granted Mother’s request 9 for vacation time with Elyse to travel to Disneyland from 7/8/2026 to 7/13/2026. The Court set a 10 review hearing for 7/21/2026. 11 6) On 7/10/2026, Father filed a declaration asking for 50/50 custody on a 2-2-5-5 schedule. He 12 states his time with Elyse has benefited her well-being, evidenced through his observation and 13 Elyse’s therapist’s remark that she is “stable and doing well.” Father states the 60/40 timeshare is 14 proving untenable; for instance, Father states Elyse has been late to school 96 times during the 15 2025–2026 school year, and nearly all those days have fallen on Mother’s custodial time.

Father 16 also states Mother failed to attend 2 of the 6 scheduled coparent counseling sessions, that the calls 17 with Mother during his custodial time are unworkable, and that the parties have been unable to 18 agree to a vacation schedule. Father requests that both parties share equal vacation and holiday 19 time: specifically, that all holidays alternate annually, that Winter Break is split in two with one 20 parent having the first week and the other having the second week. 21 7) On 7/10/2026, Mother filed a declaration stating the parties have been participating in 22 coparenting counseling with Barbara Seifer since 5/11/2026, and the sessions are 23 counterproductive as Father has not allowed any therapeutic coordination between Ms.
Seifer and 24 the parties’ individual therapists. Mother states Father continues to put Elyse in the middle of 25 parental conflict that he creates. Mother also states she is concerned that Father has not worked 26 on the underlying causes of his verbal and physical aggression, depression or suicidality and 27 challenges with emotional regulation. Mother states she is willing to accept the 2-2-5-5- 28 timeshare Father requests because continued litigation under these circumstances would only 29 cause more harm to Elyse.
Mother states she would like to have Wednesday and Thursday nights
1 and for Father to have Monday and Tuesday nights. Mother additionally requests: that the Court 2 order each parent to allow Elyse to call or text the other when she asks to do so; maintain the 3 10/16/2025 and 4/16/2026 orders except for the schedule, coparenting counseling, and calls with 4 the child; and that the Court adopt her proposed holiday schedule, under item 18 of the 5 Declaration. 6 B. Findings and Orders 7 1) This Court has jurisdiction to make child custody orders in this case under the Uniform Child 8 Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party in 9 violation to civil or criminal penalties, or both. The country of habitual residence of the minor 10 child is the United States. 11 2) The parties are ordered to appear at 9AM on 7/21/2026 in Department 404. 12
