Defendants Hinshaw & Culbertson LLP and Bradley M. Zamczyk's (collectively "Hinshaw") unopposed motion to compel Desoto Cab Co.'s compliance with a deposition subpoena for production of business records is granted in part. Hinshaw's deposition subpoena is attached as Exhibit A to the Zaheer Declaration. Desoto did not respond or object. (Zaheer Decl., Exs. 5-7.)
The court grants the motion to compel; Desoto shall provide all responsive documents within 30 days and has waived objections. The court does not grant sanctions; Desoto apparently believed this litigation was stayed by its notice of appeal of the order denying intervention or that the court would grant a permissive stay, which propounding party Hinshaw sought. The court concludes that Desoto's failure to comply had substantial justification under the unique circumstances here.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
