PLAINTIFF DISCOVERY BANK’S MOTION TO ENTER JUDGMENT PURSUANT TO STIPULATION
TENTATIVE RULING:
Plaintiff Discover Bank’s unopposed Motion to Enter Judgment Pursuant to Stipulation is GRANTED pursuant to Code of Civil Procedure section 664.6 and the terms of the parties’ stipulation.
Code of Civil Procedure section 664.6 provides a summary procedure for specifically enforcing certain settlement agreements by converting them into judgments. (Weddington Productions, Inc. v. Flick (1998) 60 Cal.App.4th 793, 809.)
Here, the parties entered into a Stipulation for (1) Entry of Judgment Upon Default and (2) Court Retention of Jurisdiction Under Code of Civil Procedure section 664.6. Defendant signed the Stipulation on July 15, 2025, and Plaintiff signed it on August 27, 2025. (Dawson Decl., ¶ 2, Exh. 1.) The Stipulation provides that Defendant is indebted to Plaintiff in the principal sum of $1,515.22, plus allowable court costs and any first appearance fee not previously paid by Defendant. The Stipulation further provides that Plaintiff would not request entry of judgment if Defendant made payments according to the agreed schedule: eleven monthly payments of $127.00 beginning on or before July 15, 2025, and continuing on or before the same day of each month thereafter, followed by one final payment of $118.22 on or before June 15, 2026. (Id., Exh. 1, ¶¶ 2–4.)
Plaintiff presents evidence that Defendant defaulted under the Stipulation after making payments totaling $254.00. (Dawson Decl., ¶¶ 6–7.) No opposition or contrary evidence has been filed. Plaintiff seeks judgment in the amount of $1,557.24, calculated as $1,515.22 in principal, plus $296.02 in court costs, less $254.00 in credits. (Id., ¶ 8.) The requested amount is consistent with the Stipulation and the evidence submitted.
Accordingly, the unopposed motion is GRANTED. Judgment shall be entered in favor of Plaintiff Discover Bank and against Defendant Hector K. Camacho in the principal amount of $1,515.22, plus costs of $296.02, less credits of $254.00, for a total judgment of $1,557.24.

If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Plaintiff shall prepare a written order consistent with the Court’s ruling for the Court’s signature pursuant to California Rules of Court, rule 3.1312, and shall provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
