Tentative Ruling
Defendant C.R.C. Roofing, Inc.s (CRC) motion for the stipulated release of funds paid into the Courts trust account is UNOPPOSED and GRANTED.
On September 2, 2022, Plaintiff Martin Tejeda, initially and derivatively on behalf of 3774 Bradview Drive LLC, a California limited liability company, and 92612 Dunes Lane, an Oregon limited liability company, filed this action against Keith Seibert, Miguel Ruiz-Gomez, Michael Sastre, and TT&G Bradview, LLC alleging several causes of action for rescission, breach of fiduciary duty, fraud, and other similar types of claims.
On October 27, 2022, the named defendants filed a cross-complaint against Tejeda and CRC alleging breach of fiduciary duty, breach of contract, conversion, accounting negligence, and quiet title.
On April 4, 2024, TT&G Bradview, LLC filed an unlawful detainer action against CRC related to the property located at 3774 Bradview Drive.
On July 19, 2024, the Court ordered the above-referenced cases consolidated. In its order consolidating the matters, the Court ordered CRC to make escrow payments of $12,000 per month from April 7, 2023 until the conclusion of the action as a condition of consolidation. (07/19/2024 Minute Order, p. 3.)
On December 16, 2024, CRC and TT&G Bradview, LLC settled the claims between them in the Tejeda matter and in the unlawful detainer action. The parties have submitted a stipulation, signed by all parties, which states that pursuant to the UD Settlement, TT&G has agreed to sell the Property to Plaintiff, with all of the Rent Funds currently held in the Courts Trust Account to be released back to C.R.C. Roofing, Inc. (Grundman Decl., Exh. A, p. 3:23-25.)
The Courts records reflect, consistent with the stipulation, that CRC has deposited $249,600.00 into the Courts trust account pursuant to the consolidation order.
Since the dispute between CRC and TT&G has resolved, and since all parties have stipulated to the release of the funds, CRCs motion is GRANTED.
The Court will sign the proposed order submitted with the moving papers.
