REVIEW HEARING

TENTATIVE RULING: The matter is set for hearing, July 28, 2026, at 8:30 a.m. in Dept. B on the Court’s Order to Show Cause re: Compliance with Court’s Order.

More than two years ago, on December 5, 2023, the Court provisionally granted Conservator’s petition to transfer the matter to Colorado. Since that time, the Court has repeatedly recalled the matter and advised Conservator that she is required to take steps in Colorado to effectuate the transfer, and, when completed, to file a Final Order Confirming Transfer, Judicial Council form GC-356, with this Court. However, there remains no GC-356 on file.

The Court hereby orders the Conservator to either complete the transfer pursuant to the Court’s December 5, 2023, Order and file the required GC-356 form or return the Conservatee to the State of California before the continued hearing date. (See Prob. Code § 2352, subd. (d).) Failure to comply with this order may lead to Civil Contempt proceedings.

APPEARANCE REQUIRED: The petition is in order. However, after the Petition was filed, a Creditor’s Claim from the State of California Franchise Tax Board was filed in the matter. That Claim is not reflected in the pending Petition or the Accounting reflected therein. Petitioner is directed to appear to discuss the issue of the pending claim and whether it requires the filing of an amended Petition (or amendment to the Petition).
