Notice Of Motion And Motion To Compel Further Responses To Plaintiffs Request For Production Of Documents, Set One
Matter on calendar for Monday, July 28, 2025, Line 9, PLAINTIFF BRITTANY SOSA, KRISTINA SOSA's Motion To Compel Further Responses To Plaintiffs Request For Production Of Documents, Set One.
Plaintiff's motion to compel further production of documents is granted. Defendant must produce all-nonprivileged documents in response to requests 1 through 31 by August 15, 2025. If there are privileged documents, a privilege log should be produced by that date.
Defendant presents no competent evidence showing that the requests are unduly burdensome. (See Michel Decl.) Defendant's boilerplate objections (e.g., vague, overbroad) lack merit and the cited discovery is reasonably calculated to lead to the discovery of admissible evidence. Plaintiff met and conferred in good faith. CCP 871.26 does not apply to this case and in any event, that statute lists initial disclosures-not the entire scope of discovery. Plaintiff's "other vehicle" request regarding the same alleged defects is proper. (See Donlen v. Ford Motor Co. (2013) 217 Cal.App.4th 138, 154 [explaining probative value of "other vehicle" evidence]; Santana v. FCA US, LLC (2020) 56 Cal.App.5th 334, 346-347 [noting intentionally inadequate "repair" of fuel pump based on defendant's prior knowledge].)
The court does not award sanctions since plaintiff's moving papers do not request them.
