Defendant Yun Choi Chow's Motion for an Order Deeming Admitted Its Requests for Admission, Set One is GRANTED. The discovery requests at issue appear reasonably calculated to lead to the discovery of admissible evidence. (CCP Section 2017.010.)
Plaintiff Marc Gerson has not established that he has provided any responses to the requests for admission (RFAs). No meet and confer requirement exists for motions to compel responses for requests for admissions when no responses have been provided. (CCP Section 2033.280.) All requests in Chow's RFA, Set One are deemed admitted.
Plaintiff Marc Gerson did not act with substantial justification in connection with these discovery requests. Plaintiff Marc Gerson shall pay $605 to Moving Defendant as sanctions, payment no later than August 8, 2025.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
