Plaintiff Talia Kennedy's motion to unseal records is denied.
Defendants filed a motion to seal documents in support of their motion for summary judgment on March 5, 2025. That motion was calendared for the same day as the motion for summary judgment, May 29, 2025. Plaintiff did not file an opposition. Out of an abundance of caution and for the convenience of the parties, the court even emailed all parties a copy of the tentative ruling on May 28, 2025, at 3:36 p.m. (Choi Decl., Exh. A.) Plaintiff did not contest.
On May 29, 2025, the court issued a ruling granting one of Defendants' sealing motions and taking the other off calendar as duplicative. This is all reflected in the register of actions. Plaintiff did not file a motion for reconsideration. Instead, Plaintiff waited until June 20, 2025, to file a motion to unseal the records, arguing there was no opportunity to object to the sealing of the records at issue.
In its order on May 29, 2025, the court made all required findings under California Rules of Court, rule 2.550(d)(1)-5, and NBC Subsidiary (KNBC-TV), Inc. v. Sup. Ct. (Locke) (1999) 20 Cal.4th 1178, 1216-1218. No circumstances have changed. The factors under rule 2.550(d) are still met. The motion lacks substantive merit. The motion is denied as it is an improper motion for reconsideration disguised as a motion to unseal records. This is an attempt to litigate the original motion to seal. The time for that has passed. Plaintiff should have opposed the motion, contested the tentative ruling, or filed a motion for reconsideration within 10 days of the order.

The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
