Plaintiff Terrence Riley's motion to compel responses to its requests for production of documents, set one, and form interrogatories, set one, from defendant Gardaworld Security Services of California Inc. is granted and the court orders sanctions of $2012.50.
Riley served the discovery in August 2024. Gardaworld served untimely, unverified responses. It has amended but has not yet served verifications. Gardaworld asks for a reduction in requested sanctions.
A party who fails to timely respond to discovery waives objections. (CCP 2030.290(a), 2031.300(a).) Discovery responses must be verified. (Id. 2030.250, 2031.250.) These statutory obligations are intended to be self-executing and it is entirely appropriate for a party to seek sanctions when these straightforward requirements are unfulfilled.
Gardaworld is ordered to provide verified, objection-free responses within 20 days of entry of this order. The court finds the sanctions amount requested to be reasonable and Gardaworld's opposition to lack substantial justification. Gardaworld shall pay sanctions of $2012.50 to Riley within 20 days of entry of this order.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
