Motion For Leave To File Confidential Settlement Agreement
Matter on calendar for Tuesday, July 8, 2025, Line 2, DEFENDANT YINGCUI LONG's Motion For Leave To File Confidential Settlement Agreement.
The motion to file confidential settlement agreement is denied without prejudice. Defendant Yingcui Long has been sued in small claims court by plaintiff Mingli Wang; the small claims case number is CSM-25-869612 and accuses Long of breaching the parties' settlement agreement by failing to pay the agreed settlement amount. Long contends that the settlement agreement was agreed by the parties to be kept confidential and seeks an order from this court that Long may file the settlement agreement publicly in light of Wang's accusation.
Presumably Long seeks to file the agreement in the small claims case and not this one. Since there is no motion to enforce the settlement agreement pending in this court there is no adjudicative purpose to file it in this case. Moreover, there is no order by the court in this case that the settlement agreement must be maintained confidentially; thus, the motion is not akin to a request for reconsideration that must be considered by the court that issued the initial order. The small claims court should decide what may be filed publicly in that proceeding. The court denies the motion without prejudicial to its renewal before the small claims court.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts. If a CSR is being retained, include in your email all of the following: their name, CSR and telephone numbers, and their individual work email address. =(301/CVA). | |
