Summary judgment is denied, insofar as plaintiffs request inclusion of monetary damages in the judgment. Plaintiffs' asserted daily rental value is based upon defendant's current service fee, which includes fees for services that are personal to the defendant's needs. Plaintiffs have not offered any authority for their apparent argument that these amounts which are in part personal to defendant are the reasonable rental value of the premises.
Summary adjudication of plaintiffs' right to recover possession of the premises is granted, subject to opposition. Summary adjudication of plaintiffs' right to recover unlawful detainer damages is denied, for the reasons previously stated.
The Court notes that this matter was previously continued at plaintiffs' request, for plaintiffs to provide supplemental briefing. However, plaintiffs did not file any supplemental briefing. =(501/SKF)
