Plaintiff Karena Apple Feng's unopposed Motion to Vacate June 6, 2025 Order is DENIED. Where a motion is unopposed, the record must reflect proper service. Plaintiff here failed to demonstrate proper service of her moving papers.
Plaintiff submitted evidence she served her moving papers by "electronic service" on "all parties." The affidavit does not show the residence or business address of the person making the service, show that the person is a resident of or employed in the county where the electronic service occurs, or show that the person is over 18 years of age. (See Code of Civil Procedure section 1013b(a)(1).) Nor does the proof identity the server's own email address or the name and email address for each recipient. (See Code of Civil Procedure section 1013b(b)(1)&(3).) Nor does the proof set out the exact title of each document being served. (See Code of Civil Procedure section 1013b(a)(1).) Plaintiff is directed to Judicial Council of California Form POS-050.
No later than 8:30 am on September 10, 2025, Plaintiff must submit a proposed order setting forth the above text.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
