Safeco Insurance Company of America's unopposed Motion For Leave To Intervene And Staying Proceedings Against Defendant Alfaro-Argumedo is GRANTED IN PART AND DENIED IN PART.
Good cause appearing, the court grants Safeco Insurance Company of America's leave to intervene as a defendant in this action. (See Code of Civil Procedure section 387(d)(1)(B).) Safeco Insurance Company of America's shall file its answer in intervention forthwith, but no later than 20 days after entry of this order.
The court denies Safeco's request to stay proceedings against Defendant Alfaro-Argumedo. The record at this time does not support such relief. Once it's a party, Safeco should continue to make best efforts to get in contact with Defendant Alfaro-Argumedo and, if those efforts fail, meet and confer with all appearing parties regarding case management.
The court denies Safeco's request for a declaration that Safeco's participation in this action as a Defendant in Intervention shall not constitute a waiver of Safeco's coverage defenses under its policy or by operation of law. On this record, the court will not make determinations about the conduct that may waive coverage defenses under the policy (which the court doesn't have and, in any event, would not canvas for purposes of this motion) or the law or whether such conduct has or has not occurred.
Safeco must lodge by email to contestdept302tr@sftc.org no later than 8:30 am on 9/30/2025 a proposed order quoting the above text verbatim.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
