Plaintiff Chikodi Chima has filed a motion pursuant to Code of Civil Procedure, section 170.6, to strike Judge Van Aken. The peremptory challenge is denied because the plaintiff has not made a declaration under penalty of perjury. Nonetheless Judge Van Aken is disqualified from hearing this matter.
Per the order of the Presiding Judge, the matter is continued to September 12, 2025 in Department 301 to be heard by a visiting judge. For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom.
