Matter on the Law & Motion/Discovery Calendar for Friday, September 5, 2025, line 9, DEFENDANT CITY AND COUNTY OF SAN FRANCISCO'S Motion To Stay The unopposed motion to stay this action pending resolution of federal cases challenging the City and County of San Francisco's COVID-19 vaccine policy is granted.
The federal cases are Gozum v. CCSF, 4:22-cv-03975-JSW; Guardado v. CCSF, 3:22-04319-JSW; Shaheed v. CCSF, 3:22-cv-06013-JSW; Cook v. CCSF, 3:22-cv-07645-JSW; Sanders v. San Francisco Public Library, 3:23-cv-00211-JSW; Monegas v. City & County of San Francisco Department of Public Health, 3:22-cv-04633; Yancey v. Breed, 4:22-cv-09045-JSW; and Royce v. CCSF, 4:23-cv-03643-JSW.
For the reasons stated in this court's order of September 28, 2023, in Kricken v. CCSF, No. CGC-22-600135, which is attached as Exhibit A to the Yan Declaration in support of this motion, the court concludes that this case raises the same subject matter as the federal cases just cited, the rights of the parties can best be determined by the federal district court, and staying this action avoids the risk of conflicting judgments.

Any party who contests a tentative ruling must send an email to contestdept301tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
