Plaintiff Adelelmo Cruz's unopposed motion to enforce settlement as a judgment and for sanctions is granted in part and denied in part; the court issues an order to show cause re sanctions.
Cruz provides a written offer, made pursuant to Code of Civil Procedure, sec. 998, signed by counsel for Cruz and for defendant American Honda Motor Co., Inc. This signed offer satisfies the requirements of Code of Civil Procedure, sec. 664, subdivision (a), for the court to enter judgment upon Cruz's motion. Cruz is ordered to provide a proposed judgment to Honda pursuant to Rule of Court 3.1312 and then to provide it to the court for signature.
Cruz also seeks sanctions pursuant to Code of Civil Procedure, sec. 128.5, subdivision (f)(2). The court issues an order to show cause to Honda and sets the OSC for hearing on October 3, 2025. Honda shall show cause why it should not be sanctioned $1,635, payable to Cruz, for failure to carry out its obligations under the settlement agreement. Honda may file a response to this OSC; any response shall be filed five court days in advance of the hearing date.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept301tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
