DEFENDANT 300 F. OGAWA PLAZA LP, RUBICON POINT PARTNERS MOTION TO STRIKE COMPLAINT is granted. All claims alleged against the moving defendants arise from their protected petitioning activity in the unlawful detainer action and prior civil lawsuit. Plaintiffs have failed to present any admissible evidence to show that their claims against the moving defendants have minimal merit. Moreover, those claims are barred by the litigation privilege.
As prevailing parties on this motion, moving defendants are awarded reasonable attorneys' fees of $14,077.50. The request for fees for filing the reply papers is denied because it was not reasonably necessary to file reply papers in light of the patently deficient opposition papers. =(501/HEK)
