NOTICE: The Sacramento Superior Court is transitioning operations from the Gordon D. Schaber and Hall of Justice buildings to the new Tani G. All hearings currently scheduled or reserved after the effective date shall remain in place and will be heard in Department 16C.

TENTATIVE RULING:

Defendant Access Physician Inc.’s (“Defendant”) motion to seal is UNOPPOSED and GRANTED.

Defendant seeks to seal the first page of Exhibit K attached to the Declaration of Faith Wolinsky in Support of Defendant API’s Motion to Compel Further Responses to Special Interrogatories, Set Two, filed on July 15, 2025, because the exhibit contains unredacted references to Plaintiff’s legal name, which Defendant contends is private. Plaintiff’s unredacted name only appears on the first page of Exhibit K.

A court may order a record to be filed under seal only if it expressly finds facts establishing: (1) there exists an overriding interest that overcomes the right of public access to the record; (2) the overriding interest supports sealing the record; (3) a substantial probability exists that the overriding interest will be prejudiced if the record is not sealed; (4) the proposed sealing is narrowly tailored; and (5) no less restrictive

means exist to achieve the overriding interest. (California Rules of Court, rule 2.550(d); NBC Subsidiary (KNBC-TV), Inc. v. Superior Court (1999) 20 Cal.4th 1178, 1217-1218.)

The Court finds that Defendant’s motion meets this standard. Accordingly, Defendant’s motion is GRANTED.

Defendant, however, must file the entire and properly redacted Declaration of Faith Wolinsky in Support of Defendant API’s Motion to Compel Further Responses to Special Interrogatories, Set Two. The Court’s system does not permit the replacement of singular pages. Once filed, the clerk is directed to promptly back-date the declaration to July 15, 2025.

The clerk is directed to promptly change the security clearance for the Declaration of Faith Wolinsky in Support of Defendant API’s Motion to Compel Further Responses to Special Interrogatories, Set Two filed on July 15, 2025, so that it is no longer viewable by the public.

This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc., § 1019.5; Cal. Rules of Court, rule 3.1312.)

Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporter’s Office and an official reporter will be provided.
