The motion of Plaintiff Jeffery Scott Stephens (“Plaintiff”) to set trial prior to December 2, 2025 is ruled on as follows.

Plaintiff commenced this action by filing a complaint on December 2, 2020. Trial was previously scheduled for May 13, 2025. On February 14, 2025, the Court granted a motion to vacate trial and referred this action to the Trial Setting Process. Based on Plaintiff’s representation that the deadline to commence trial is December 2, 2025, the Court’s order expressly directed the parties to select a trial date before that deadline. The parties failed to agree on trial date. Plaintiff now moves the Court to set trial before December 2, 2025. Plaintiff does not specify a proposed date, but provided some information regarding Plaintiff’s availability.

No party opposed the motion, nor did any party provide information regarding their availability for trial.

When parties fail to select a trial date through TSP, the Court will ordinarily assign the first available trial date, which is currently June 24, 2025. However, the record indicates the parties have reserved a hearing for a motion for summary judgment on August 25, 2025. The Court will therefore select the first date available that will permit a motion to be heard on that date and does not conflict with Plaintiff’s availability.

The motion is granted. Trial is set for December 1, 2025 at 8:30 a.m. in Department 47. A mandatory settlement conference is scheduled for October 30, 2025 at 9:30 a.m. in

This case has been assigned to Department 47 for hearing. In the event that either party requests a hearing the matter will be heard at 9:30 a.m. in Department 47. Any party requesting an oral argument must contact the clerk at (916) 874-5487 and opposing counsel or parties in pro per by 12:00 p.m. on the day before the hearing. If a proper request for hearing is not made, this shall become the order of the Court.

If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will be forward the form to the Court Reporter’s Office and an official reporter will be provided.
