Plaintiff Genoa Martell's Motion To Extend Time To Pay Monetary Sanctions And To Temporarily Stay Enforcement is GRANTED IN PART AND DENIED IN PART. The motion to stay enforcement of the sanctions is denied. Good cause appearing the court modifies its September 22, 2025 Order to provide that Plaintiff must pay the sanctions ordered ($2,860) to Defendants in monthly installments of $476 due the first of each month, starting December 1, 2025, and ending May 1. 2026, except that the May 2026 payment shall be in the amount of $480 (the balance then remaining).
If a payment is ten calendar days late, the full balance shall become due immediately. Plaintiff's "limitations" showing was not compelling, especially given her level of activity in this case. Should Plaintiff engage in further activity that gives rise to sanctions, the court will expect payment under the terms set out in the court's sanctions order.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
