Before the court is an unopposed Motion to be Relieved as Counsel from Counsel Nelson Goodell, counsel of record for Plaintiff Geoffrey Lynch. The motion is DENIED WITHOUT PREJUDICE.
First (and primarily), the court is not inclined to relieve counsel by order one the (literal) eve of a discovery deadline. Counsel must address imminent discovery issues or obtain extensions of time that reasonably allow Plaintiff to address the issues.
Second, "[b]reakdown in attorney-client relationship" without more is conclusory and, thus, insufficient as a reason for the motion. The court is confident more information can be provided in the declaration consistent with ethical obligations. If the motion is renewed, counsel must make every effort to disclose the reasons for the motion in their declaration. The court understands an in camera hearing is sometimes necessary. If counsel intends to rely on an in camera hearing, then counsel must be prepared to personally appear at the courthouse on the date noticed for the hearing so the in camera hearing can proceed.
