The unopposed motion to seal is granted. This motion to conceal concerns Exhibits 1 through 12 (Volumes 1-3) attached to the Supplemental Declaration of Parker Berling in Support of Opposition to Motion for Assignment Order, and Exhibits 1 through 5, Exhibits 7 through 10, and Exhibit 12 attached to the Filed Under Seal Declaration of Bart Dalton in Support of Sur-Reply Brief in Support of Motion for Assignment Order. The court finds that these materials contain confidential trade secrets, including financial information and licensee lists.
As to these materials, the court finds that (1) there exists an overriding interest that overcomes the right of public access to the record; (2) the overriding interest supports sealing the record; (3) a substantial probability exists that the overriding interest will be prejudiced if the record is not sealed; (4) the proposed sealing is narrowly tailored; and (5) no less restrictive means exist to achieve the overriding interest.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
