Plaintiff Geremie Dean moves for an order compelling defendant Oscar Camacho Cardona to respond to plaintiff's form interrogatories and special interrogatories. Plaintiff's moving declaration states that no "verified" responses were received (Mehta Decl. para 8) but does not mention the relevant fact that unverified responses were served on September 8 by electronic service, three days prior to the September 11 filing of this motion. Verifications were served September 23, 2025.
The court denies the motion as moot and denies sanctions. Plaintiff's failure to state in moving papers that defendant served unverified responses is concerning to the court. The court finds it would be unjust to award sanctions here.
