Plaintiff Terrence Riley's motion to compel defendant Safeway Inc. to produce its PMQ deponent, with documents sought in the deposition notice, is granted. Safeway's delay in identifying dates and producing the deponent are unreasonable. Safeway shall produce its PMQ in December. The parties are directed to meet and confer about dates within one week of this order but if Safeway does not provide at least three available dates for its PMQ during those meet and confer efforts, Riley may unilaterally set the date and Safeway is ordered by the court to produce its deponent on the unilaterally-set date.
Safeway's discovery conduct lacks substantial justification. The court orders Safeway to pay $2,362.50 to Riley by December 5, 2025. The court repeats the admonition made in Judge Mayfield's order of November 6, 2025 to co-defendant Gardaworld: Safeway failure to comply with its discovery obligations may subject it to evidentiary, issue, or terminating sanctions.

The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
