Plaintiff's motion to compel defendant Gardaworld Security Services of California, Inc.'s person most knowledgeable to appear, testify, and produce documents is GRANTED. Plaintiff demonstrates good cause for the discovery as it is reasonably calculated to lead to the discovery of admissible evidence. (CCP 2017.010.)
Defendant failed to appear at the 6 noticed depositions and despite having an opportunity to do so, failed to provide alternative dates in a timely fashion. (See Wolff Decl., pars. 4-6, Ex. A.) Defendant only proposed dates three weeks after plaintiff filed and served this motion. Defendant's stonewalling lacks substantial justification.
Defendant's PMK shall appear for deposition by November 26, 2025. Defendant shall remit $2,362.50 as reasonable sanctions for the cost of this motion by November 26, 2025. Lastly, Defendant shall pay the $2,012.50 in sanctions the court ordered on July 10, 2025, by November 6, 2025. The court notes that further discovery derelictions may lead to issue, termination, or contempt sanctions.
