Cross-defendant Precision Engineering, Inc.'s motion for summary judgment is granted. Precision has satisfied its summary judgment burden by showing that the discovery responses of cross-complainant Shimmick Construction Company, Inc. are devoid of facts showing that any conduct of Precision is responsible for the construction defects complained of by plaintiff City and County of San Francisco and Shimmick. Because Shimmick has not submitted any evidence on this motion showing that Precision is responsible for those construction defects, Precision is entitled to summary judgment in its favor.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
