Plaintiff Raymond Vincent DiGiacomo, Jr.'s motion for an ordering requiring defendant Denise Williams to further respond to his form interrogatories, set one, is granted in part and denied in part.
Williams is ordered to make further responses to form interrogatory nos. 2.1(b), 2.1(c), 2.7(a), 2.7(b), 2.7(c), and 2.7(d). These are basic background questions that parties to litigation should expect to respond to; they go to credibility and enable party-opponents to conduct investigation. Williams expresses privacy fears, but none of the information requested appears to the court to be sensitive information. DiGiacomo is ordered to use the amended responses only in connection with this litigation.
Williams has represented she will amend her response to form interrogatory no. 2.8. The court orders her to do so. Williams's response to form interrogatory no. 17.1 is sufficient and no further response is ordered. Williams shall make the further responses ordered herein within 30 days.
The court denies DiGiacomo's request for an order compelling a wet-signature verification for the reasons stated in the court's companion order denying further responses to RFP No.
1.
Both parties seek sanctions. The court concludes that both parties' discovery positions lacked substantial justification and does not award sanctions.
