Procedural History 18 1) Michael Jermaine White (Father) and Marissa Masumitsu (Mother) have one minor child 19 together, Zendaya (DOB 2/9/2014, age 12). Mother has had sole legal and physical custody of 20 Zendaya since 2018. 21 2) In April 2021, the Court suspended Father’s visits after he failed to exercise his visits or 22 participate in the proceedings. On 3/17/2026, after Father filed a request to resume visits, the 23 Court maintained the order for sole legal and physical custody to Mother and ordered supervised 24 visits for Father at Rally Family Visitation Services (Rally).
The Court set a review hearing for 25 5/19/2026, then continued the hearing to 8/27/2026 after receiving a report from Rally that the 26 parties had not yet been placed on Rally’s waitlist because Father had not submitted his 27 application fee. The Court ordered the parties to file and serve update declarations 10 days before 28 the 8/27/2026 hearing. 29
1 3) Mother has filed update declarations stating Father has not yet completed the Rally process and 2 that visits have therefore not begun. She states she has complied with all Court orders since 2018, 3 including the most recent order for her to complete the intake process with Rally, and states that
4 Father consistently fails to follow through.
5 4) Father has not filed an update declaration. 6 B. Findings and Orders 7 1) This Court has jurisdiction to make child custody orders in this case under the Uniform Child 8 Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party in
9 violation to civil or criminal penalties, or both. The country of habitual residence of the minor
10 child is the United States. 11 2) The Court finds it is in Zendaya’s best interest to maintain sole legal and physical custody to 12 Mother and suspend Father’s visits. The Rally order is hereby vacated. 13 3) The Court will prepare the Findings and Order After Hearing.
