PLAINTIFF GARY ERWIN Re-Filed Motion For Terminating Sanctions, Issue Sanctions, Monetary Sanctions, And Order To Show Cause Re: Contempt; is DENIED.
Based on the evidence presented neither sanctions nor OSC re: contempt are warranted. Moving papers are almost completely devoid of legal authorities in support of plaintiff's position. Reliance on Stephen Slesinger, Inc v. Walt Disney Co. (2007) 155 Cal.App. 4th 736 is misplaced. No evidence presented that Defendants violated CCP 1209(a)(5).
To the extent Plaintiff claims that Defendants failed to file a supplemental brief in response to this Court's October 3, 2025 Order, this contention is false. Supplemental brief was filed on October 6, 2025, and considered by the Court as is evidenced by the Court's October 10, 2025 ruling.
It appears that reply relies on additional purported violations of procedural requirements arising out of the events that occurred after the motion was filed (proposed orders after demurrer and motion to strike November 5, 2025 hearing). These new arguments are not proper as Defendant has no opportunity to respond. Additionally, failure to comply with CRC 3.1312 does not give rise to any of the sanctions requested by the Plaintiff in this motion. =(501/SKF)
