Tentative Minute Order The Court discusses with the parties issues regarding burden and sampling with regard to the Belaire West notice and with regard to litigation of the issue concerning class members who have signed arbitration agreement. The Court has made no rulings at this time. In open court today, all parties orally stipulated to lift the stay on discovery as to putative class members who have signed arbitration agreements or are bound by a Collective Bargaining Agreement. In open court today, all parties orally stipulated to extend the deadline for Plaintiff to file and serve a motion for class certification to May 10, 2027.
It is so ordered. By stipulation of the parties, the deadline for Plaintiff to file and serve a motion for class certification is CONTINUED to May 10, 2027. The Non-Appearance is continued to May 17, 2027. Defendant may file and serve a motion to deny class certification or to decertify a class at any time. Notwithstanding the stipulations above, each Party preserves all objections and arguments. Prior to finalizing this minute order, the Court posted this minute order on CaseAnywhere, and all Counsel agreed to the accuracy of this minute order in reflecting the parties' stipulations.
