on 4/16/26 and set the matter for hearing on 10/27/26. Moving papers sought dismissal and/or monetary sanctions. Plaintiff dismissed the entire action without prejudice on 6/01/26. On 6/04,Honda filed a request to stay the order of dismissal because it wanted its sanctions. The same day, Honda filed a notice of non-opposition to the motion for terminating sanctions; the notice of non-opposition was not filed by Plaintiff, and is therefore not an indication that Plaintiff actively does not oppose the request for relief.
On 6/12, the Court "pursuant to an oral request made by Plaintiff and Defense," dismissed the case with prejudice. The Court also set a hearing on a motion for sanctions for 8/11/26, which order appears to be intended to set the aspect of the 4/16/26 motion that sought monetary sanctions for hearing. Honda's 4/16/26 notice of motion, however, fails to comply with CCP Sec.2023.040 as it relates to monetary sanctions. Sec.2023.040 requires the notice of motion to identify each person, party, and/or attorney against whom the moving party seeks sanctions.
The Court notes that Department S27 has repeatedly denied Defendant's requests for sanctions in other actions due to the failure to comply with this requirement, and yet Defendant continues to fail to comply.
