The Status of Settlement Hearing is CONTINUED TO JUNE 11, 2026, AT 9:00 AM IN THIS DEPARTMENT. Plaintiff shall file a memorandum (and appropriate declarations) identifying and discussing status of settlement and outstanding issues no later than 10 calendar days before the hearing, with courtesy copy delivered to the department within 24 hours of filing.
To be clear, the court is not "erroneously assum[ing] the case has not been settled." (See 12/2/2025 MPA at p. 1.) The court understands a settlement has been reached. The status hearing is to ensure all acts required under the settlement have been performed. The parties are to exercise due diligence to complete all acts required by the settlement.
Additionally, contrary to counsel's representation, Judge Feng, not Judge Cheng, presided on October 17, 2025. (Id at p. 2.) Further, contrary to counsel's representation, the proposed order submitted on November 11, 2025, has, in fact, been signed-it was signed November 12, 2025. Finally, a judgment has now been entered.
Plaintiff is ordered to prepare a proposed order which repeats verbatim the above text and email it to contestdept302tr@sftc.org no later than 8:30 a.m. on December 12, 2025.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing. Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
