Plaintiffs’ Motion to Compel Production of Documents or Statement of Inability to Comply from Third Party Intermedia.net Inc. is DENIED.

This motion was originally scheduled for hearing on July 27. It was continued to August 26 because Plaintiffs had not filed a proof of service demonstrating service of this motion on nonparty Intermedia.net Inc., as required by California Rules of Court, Rule 3.1346.

In its July 27, 2026 order continuing the hearing on this motion, the Court directed Plaintiffs to serve Intermedia.net Inc. with a Renotice of Motion, indicating the continued August 26, 2026 hearing date, along with the moving papers no later than July 31, and to file the Renotice of Motion and the proof of service by August 7, 2026.

Plaintiffs filed the Renotice of Motion on July 30. However, in the proof of service filed that same day, Plaintiffs stated that they had served the Renotice of motion and moving papers on counsel for Defendants only. The proof of service filed July 30, 2026 did not indicate that the Renotice of motion or moving papers had been served on nonparty Intermedia.net Inc.

To this date, Plaintiffs have never filed a proof of service indicating that this motion has ever been served on nonparty Intermedia.net Inc., despite repeated opportunities to do so.

This motion is DENIED on that basis.
