2025PRCE047208: IN THE MATTER OF ROBERT MICHAEL MILLER 08/25/2026 in Department J6 Hearing on Petition to Approve Reimbursement of Expenses
The Court authorizes petitioners Bradley Polk Miller and Sally B. Miller to reimburse themselves $3,000.00 for expenses incurred on behalf of the conservatorship estate. With respect to the loan from Ms. Johnson the Court notes the following issues: The petition does not provide sufficient documentation of how the money loaned from Ms. Johnson was spent. The petition states that on 7/24/25, $3,075.38 room and board charges were paid to Lexington Assisted Living. However, the Lexington invoice shows that the check for the 7/24/25 payment (#6177) was returned on 7/29/25 and there was a reverse payment.
Also, the petition does not state that the 7/24/25 payment came from Ms. Johnsons loan, although as this payment was returned this is a moot point. The petition also states that on 9/1/25, there was $9,435.52 room and board charges and that $1,150.76 of this amount came from the loan from Ms. Johnson. However, the Lexington invoice states that the payment of $9,435.52 was made on 8/11/25 (not 9/1/25) by #100. Was check #100 from conservators account (check number does not align with conservators check #2073)?
Did the 8/11/25 payment utilize the entire $5,000.00 loan from Ms. Johnson or just $1,150.76?
