TENTATIVE RULING:

In pro per Defendant Brandon Kyle McElhaney, Trustee of the Sylvan Grove Trust’s (“Defendant”) motion to deposit settlement under Code of Civil Procedure section 572 and request for entry of judgment under Code of Civil Procedure section 664.6 is DENIED as follows.

This is an action to, inter alia, quiet title to the real property located at 7337 Sylvan Grove Way, Citrus Heights, California 95610 (the “Property”) following a nonjudicial foreclosure sale on October 18, 2022. Plaintiff Newrez LLC dba Shellpoint Mortgage Servicing (“Plaintiff”) and Defendant each claim an ownership interest in the Property.

By way of the instant motion, Defendant asks the Court to deposit and liquidate a promissory note as payment for a purported settlement agreement and to enter judgment under Code of Civil Procedure section 664.6 pursuant to the purported settlement.

Defendant’s motion is premised upon the existence of a settlement agreement. However, the emails exchanged between the parties evince settlement negotiations/discussions, not an agreement. Moreover, enforcement proceedings under section 664.6 require either a stipulation to settle “orally before the court” or a written settlement “signed by the parties.” (Code Civ. Proc., § 664.6, subd. (a).) Defendant has shown neither. (See J.B.B. Investment Partners, Ltd. v. Fair (2014) 232 Cal.App.4th 974, 989 [reversing an order enforcing a settlement under CCP section 664.6, finding a printed name at the bottom of an email responding to a settlement offer did not constitute a signature].)

For the stated reasons, Defendant’s motion is denied.

Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away.
