Plaintiff Ron Roussell's Motion To Dismiss Individual Claims With Prejudice And Class/Representative PAGA Claims Without Prejudice is OFF CALENDAR.
Plaintiff filed a class action in this court, CGC-24-614539. Plaintiff later filed the instant PAGA action involving substantially identical facts. Plaintiff plans to seek dismissal of both actions on the same grounds.. One bench officer should resolve the dismissal issue as to both cases. Plaintiff never filed a Notice of Related Case, nor does the docket indicate they have yet sought consolidation or coordination. Plaintiff is ordered to file a notice of related cases (as required by the rules) and pursue consolidation and/or coordination. Thus, the court will have the opportunity to ensure one bench officer resolves the dismissal issue as to both cases. This motion is off calendar, to be renewed once the above process has played out.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
