DEFENDANT ALBERTO TRUJEQUE, HOLANDA PEREZ Motion To Quash Subpoena And Request For Attorney'S Fees And Costs is DENIED.
The trial date was continued to June 1, 2026 for the specific purpose of allowing Plaintiff to conduct discovery on Defendants' affirmative defenses that were revived as a result of the granting of Defendants' request to withdraw their admissions on the day of trial. The subsequent denial of Defendants' motion to reopen all discovery in this action does not invalidate the conditions imposed on the granting of Defendants' motion to withdraw their admissions.
It appears from Defendants' moving papers that Defendants intentionally omitted any reference to the reason for the continuance to June 1, 2026 in order to mislead the Court regarding the facts and procedural history relevant to this motion, and gain an unfair advantage from the relief Judge Haines previously granted to them.
Plaintiff's request for sanctions in opposition is denied without prejudice, as Plaintiff cited no legal authority for this request. =(501/DWH)
