This matter is on calendar for hearing on a Spousal Property Petition. The matter has been properly noticed with proof of service on file. No objections have been raised. The decedent died testate, and the will provides that all decedent’s property be given to The Freeman Living Trust dated April 21, 1998, not to the surviving spouse. In so far as the Petition requests a determination that the decedent’s one-half community property passes to the surviving spouse, the Petition is DENIED. The Court notes a copy of the Corporation Grant Deed has not been provided as indicated in Attachment 7 and no other evidence has been provided regarding the characterization and title of the property.

Therefore, the Court is unable to confirm the surviving spouse’s one-half community property interest in the subject property. The matter is continued to Monday, June 22, 2026, at 2:30 p.m. in Department 44 for further proceedings regarding the Spousal Property Petition. A supplemental declaration is required to be filed and served to address the issue raised above and to permit the Court to grant the Petition to confirm the surviving spouse’s one-half interest. No appearance is necessary on today’s calendar.
