Ruling

24CV103531: MCCRAY, et al. vs NISSAN NORTH AMERICA, INC, et al. 08/14/2026 Pre-Trial Conference in Department 24

Tentative Ruling - 08/12/2026 Rebekah Evenson

Trial counsel must appear in person for pretrial conference.

Counsel of record must appear in person for hearing on Order to Show Cause.

On 5/27/26, Plaintiff filed a Notice of Plaintiff's Death.

on that same date, the Court ordered Plaintiff's counsel to file a motion to substitution successor in interest no later than 6/3/26. To date, no such motion has been filed. The Court also ordered the parties to file a complete set of the required trial documents, and to deliver courtesy copies.

As of 8/12/26, the parties have not complied with the May 27 order, nor have they filed any declarations in response to the order to show cause re sanctions. Accordingly, the Court is tentatively inclined to issue sanctions against Plaintiff's Counsel of Record, and possibly against Defendant's Counsel of Record, for violations of this Court's prior orders.
