Hearing Time: 9:00 AM) 9 ZACHERY BLAIR POZNER,) Department: 404) 10 Respondent) Presiding: AI MORI) 11) 12 ORDER TO SHOW CAUSE AND AFFIDAVIT FOR CONTEMPT 13 TENTATIVE RULING 14 Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the 15 Court makes the following findings and orders: 16 1) On for hearing is Respondent Zachary Blair Pozner Order to Show Cause Re: Contempt filed 17 3/6/2026. 18 2) Respondent alleges that Petitioner Dera-Jill Lamontagne Pozner violated the Findings and Order 19 After Hearing filed 11/20/2025 and Temporary Emergency (Ex Parte) Orders filed 1/26/2026 which 20 required Petitioner to make specified payments to Respondent. 21 3) There is no Proof of Service on file demonstrating service of Respondent’s Order to Show Cause Re: 22 Contempt. 23 4) The hearing on Respondent’s Order to Show Cause Re: Contempt filed 3/6/2026 is hereby continued 24 to Tuesday, 7/7/2026 at 9:00 AM in Dept. 404. 25 5) By the deadlines specified in the Code of Civil Procedure, Respondent shall have his Order to Show 26 Cause Re: Contempt filed 3/6/2026 personally served on Petitioner, along with a copy of the 27 Tentative Ruling Instructions and the Findings and Order After Hearing for the 5/5/2026 hearing date. 28 6) Petitioner shall file and serve an Income and Expense Declaration at least 5 calendar days prior to the 29 next hearing date if Petitioner will be requiring the appointment of contempt counsel to represent her.
1 7) Respondent’s attorney shall prepare the Findings and Order After Hearing. 2 8) Preparation of Order: If you are directed by the court to prepare the order after hearing – within 10 3 calendar days of the hearing you must either: (a) Serve the proposed order to the other party/counsel 4 for approval, and follow the procedures set forth in CA Rules of Court, Rule 5.125(c), or (b) If the 5 other party did not appear or the matter was uncontested, submit the proposed order after hearing 6 directly to the court. Failure to submit the order after hearing within 10 days may allow the other 7 party to prepare a proposed order and submit it to the court in accordance with CA Rules of Court, 8 Rule 5.125(d). 9
