18 A. Procedural History 19 1) Petitioner Jose Antonio Ayon Bravo (Father) and Paris E. Carr (Mother) have one minor child 20 together, Isela (DOB 10/1/2022, age 3). 21 2) In a Stipulation and Order filed 1/22/2025, the parties agreed to share joint legal and joint 22 physical custody of Isela, with Father to have parenting time every Saturday at 8pm to Tuesday at 23 9am. The Stipulation and Order also provides that Mother shall provide all transportation, 24 exchanges shall occur at Father’s home, the parties shall communicate by text message and phone 25 call regarding any issues that relate to Isela, the parties may change the parenting time schedule 26 as needed per mutual agreement, and the parties will work together to create a holiday schedule. 27 3) On 2/4/2026, Father filed a request to modify the parenting time to every Saturday at 8am to 28 Sunday at 8pm.
He states the parties followed the parenting time schedule set forth in the 29 Stipulation and Order until he got a new job about 6 months ago and the parties moved to Los
1 Angeles together for two months. After their return, Mother moved to San Jose and Father began 2 visiting with Isela in San Jose, primarily on Sundays. However, Mother has not permitted Father 3 to “take our daughter for visitation” and wishes for visits to occur only in her home. Father states 4 he wishes to take Isela to his home as well. His current work schedule is Monday through Friday,
5 which means he is available to parent Isela only on the weekends. 6 4) The parties attended mediation and did not reach an agreement. Mother is asking that Father have 7 parenting time every Tuesday from 9am to 5pm and every Saturday 9am to 5pm. Father is 8 requesting that he have parenting time every Monday at 8am to Tuesday at 8pm; he agrees to 9 provide transportation. 10 B. Findings and Orders 11 1) This Court has jurisdiction to make child custody orders in this case under the Uniform Child 12 Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party in
13 violation to civil or criminal penalties, or both. The country of habitual residence of the minor 14 child is the United States. 15 2) The parties are ordered to appear at 9am on 4/28/2026 in Department 404 in person or via 16 Zoom video.
