Procedural History 18 1) The parties are Petitioner Monika Mastalerek (Mother) and Respondent Daniel Lobert (Father). 19 They share one minor child: Matthew Lobert (DOB: 11/27/18). 20 2) The Court notes the parties related dissolution action – case number FDI-23-798868 – which was 21 filed by Mother on November 7, 2023. 22 3) A hearing was held in the aforementioned dissolution action on December 4, 2025. On that day, 23 the Court issued orders relating to a 3111 evaluator, therapy for Matthew, and a review hearing 24 set for April 7, 2026.
At the time of that hearing, the parties were residing in the same household 25 and the Court did not make any specific orders related to custody and parenting time. 26 4) On February 4, 2026, the Court issued a Restraining Order After Hearing (ROAH) for a three- 27 year period protecting Mother from Father. The Court did not include the minor child as a 28 protected party. The Court granted Mother sole legal and sole physical custody of the minor 29
1 child and ordered agency supervised visitation to Father. The Court set a review hearing for 2 April 16, 2026 to review the status of Father’s supervised visitation. 3 5) On April 6, 2026, the Court signed a stipulation and order, which continued the April 7, 2026 4 review hearing to be combined with the review hearing set on April 16, 2026. 5 6) As of April 9, 2026, the Court has not received any update declarations in either action by either 6 parent. 7 B. Findings and Order 8 1) This Court has jurisdiction to make child custody orders in this case under the Uniform Child 9 Custody Jurisdiction and Enforcement Act.
A violation of this order may subject the party in 10 violation to civil or criminal penalties, or both. The country of habitual residence of the minor 11 child(ren) is the United States. 12 2) Case number FDV-25-818806 is hereby consolidated into and under related case number FDI-23- 13 798868. 14 3) All future filings for these matters shall be filed under related case number FDI-23-798868 (i.e., 15 the lead case). 16 4) Mother shall continue to have sole legal and sole physical custody of the minor child. 17 5) The Court orders both parties to appear to obtain information from the parents as to the status 18 of supervised visitation. 19
