LUNA) 11) 12 REQUEST FOR ORDER: STAY PROCEEDING PENDING RESOLUTION OF RELATED CIVIL 13 CASE; REQUEST FOR ORDER CHANGE: TO CORRECT CLERICAL ERROR OR MODIFY 14 ORDER OF 02/15/24 15 TENTATIVE RULING 16 Having read and considered the pleadings, declarations, and other evidence submitted in this matter, the 17 Court makes the following findings and orders: 18 1) The parties are Petitioner Anita Yuan Yun Huang and Respondent Wen Hua Yang. 19 2) On 2/15/24, the Court issued a Final Statement of Decision and Order, which includes disposition 20 of the jointly owned condominium located at 110 Otter Cove Terrace in San Francisco CA.
The 21 Court ordered, in pertinent part: “The condominium is assigned to Petitioner, with an equalizing 22 payment owed by Petitioner to Respondent in the amount of $366,000. Petitioner shall have until 23 August 31, 2024 to arrange the financing necessary to purchase Respondent’s community 24 property share of the condominium. If she is unable to do so by that date, the condominium shall 25 be sold and the net proceeds split evenly between the parties after the payment of commissions, 26 fees, taxes, and other closing costs.
In the event the condominium is to be sold, Petitioner shall 27 provide Respondent with the names of three proposed local real estate agents to act as the listing 28 agent no later than September 21, 2024.” See Final Statement of Decision and Order filed 29 2/15/24.
1 3) On 3/3/26, the Court denied Respondent’s request for enforcement of the Final Statement of 2 Decision and Order filed 2/15/24 as Judgment was not yet entered. 3 4) On 4/10/26, the Court entered Judgment on the Statement of Decision file dated 2/15/24. 4 5) On for hearing on 4/16/26 is (a) Petitioner’s Request for Order filed 3/16/26 seeking modification 5 of the Court’s Statement of Decision file dated 2/14/24; and (b) Petitioner’s Request for Order 6 filed 3/16/26 seeking a stay of the instant proceedings pending resolution of a civil case Petitioner 7 filed in San Mateo County.
Both requests were submitted ex parte and denied pending hearing set 8 for 4/16/26. 9 6) Respondent filed two Responsive Declarations in opposition of Petitioner’s requests, one file 10 dated 3/12/26 and one file dated 4/3/26. Respondent seeks $1,500 in sanctions pursuant to Family 11 Code section 271. 12 7) The Court finds good cause to DENY Petitioner’s Request for Order filed 3/16/26 seeking 13 modification of the Court’s Statement of Decision file dated 2/14/24; and (b) Petitioner’s Request 14 for Order filed 3/16/26 seeking a stay of the instant proceedings pending resolution of a civil case 15 Petitioner filed in San Mateo County.
There is no legal basis to modify the Court’s Final 16 Statement of Decision and Order filed 2/15/24 or stay these proceedings. 17 8) Respondent’s request for $1,500 in sanctions pursuant to Family Code section 271 sanctions is 18 GRANTED as the Court finds Petitioner’s conduct has caused unnecessary delay. This balance 19 shall be paid in full to Respondent from Petitioner’s share of the net sale proceeds of the 20 condominium. 21 9) The Court will prepare the Findings and Order After Hearing. 22
