EVENT: Motion to Set Aside Default

Motion to Set Aside Default is GRANTED. The request for sanctions is denied. The Court appreciates Plaintiffs’ frustration considering this case is nearly two years old and yet there has been no mediation (which was apparently promised by Defendants) nor has there been a responsive pleading filed by Defendants. Technically this motion is defective in that it does not attach a copy of the responsive pleading as required by CCP 473(b). However, if the parties are still interested in pursuing arbitration the proposed pleading requirement may be moot in this instance. In any event, in the interests of moving this case forward, the motion is granted and Defendants are ordered to file a responsive pleading within ten days of this order. Defendants shall prepare and submit the form of order.
